Never applied to extend your status? OH, OH
When you were admitted into Canada for a temporary period of time you never expected the COVID19 pandemic to hit.
You never expected the airline flights out of Canada to be cancelled.
You never expected the Colleges and Universities to be closed.
You never expected that your employer would be required to close their business.
It does not matter how concerned you were about staying safe in Canada or how much stress you had about your other family members back home that caused you to forget to apply to extend your status in Canada. It does not matter that you could not leave Canada when your visitor status expired. It does not matter that your College ended up closing and you could not attend classes. It does not matter that your employer was forced by the government to close. You are in the wrong for not applying to extend your status.
Applications to extend temporary status are to be submitted to the Edmonton, AB Case Processing Centre. Even though the Edmonton CPC was closed as long as you had submitted your application to extend your status you would of been okay. Immigration Officers at the Edmonton CPC decide to issue an extension or deny an extension. If less than 90 days have expired since your status expired you can still apply for reinstatement by providing a logical excuse.
Once you have been refused an extension or you are not eligble for reinstatement of your status because too much time has elasped your file will be turned over to the Canada Border Service Agency (CBSA) which are responsible for enforcing the Immigration Act and all of its regulations. CBSA Officers look at your violations in Black and White. Either you’re in status or out of status, either you complied with the Act and the Regulations or you didn’t. Their job is to bring violaters to justice and affect their removal from Canada.
During your visit to Canada, while studying in Canada, or working in Canad you meet your soul mate. If you are now OUT-OF-STATUS and your married their is no guarantee that CBSA will allow you to remain in Canadaa while your spousal sponsorship application is processed from within Canada. Did you delay asking your soul mate (will you marry me) because you did not want them to think you are using them to gain permanent residency in Canada? Does your soul mate know that you are currently OUT-OF-STATUS in Canada?
Obtaining a Marriage License has been impossible during COVID19 pandemic so your soul mate has put off applying to sponsor you.. NO EXCUSE!
Just because you applied to extend your visitor status in early February 2020 when your status was to expire March 01st, 2020 does not guarantee you will get another six month extension when Edmonton CPC finally assess your application. What if they ive you five days from the date you receive the IRCC letter?
Just because you applied to extend your study permit in early February 2020 when your status was to expire March 01st, 2020 does not guarantee you will get approved when Edmonton CPC finally assess your application. What if your College has not announced they are opening for the fall session.
Just because you applied to extend your work permit in early February 2020 when your status was to expire March 01st, 2020 does not guarantee you will get approved when Edmonton CPC finally assess your application. Will you be able to convince an Immigration Officer that your company is still in business?
Recently an elderly couple who have been in a on and off relationship for more than twenty years got legally married in February 2020 in Canada. They applied themselves for an extension of the applicants visitor status. They retained us acted us two weeks ago to submit a spousal application because they found the process confusing. Lat week the husband/applicant was given a 5 day extension to his visitor status.
I have had numerous discussions with the Mother of a 22-year-old Filopino Canadian who has been engaged to a visitor from the Philippines. The couple respecting their relkigous beliefs have not resided together for a year so there is no option of submitting a common-law application.
Their wedding has been delayed because until the end of July they are unable to obtain a marriage license from City Hall government office. I then informed them that even after they get married they won’t be able to submit their married spousal application until they obtain a MARRIAGE CERTIFICATE.
I tried my best to convince them to submit a CONJUGAL SPONSORSHIP APPLICATION! They convinced me that they are committed to one another and very much in love. I explained to them that once they obtain the marriage certificate we can switch their appliction status to MARRIED. Nothing I could say would convince them that the future wife would not get another six month visitor extension.
So I let them speak to the 76-year-old couple who got a 5 day extension. RETAINED!
