Sponsors and Applicants can sometimes make mistakes when they decide to DIY instead of retaining experienced Immigration Counsels. Dual citizen (Dutch - Filipino) fled an abusive relationship and gave birth to her daughter in the Philippines. Included her childs biological fathers name on the birth certificate.
Came to Canada to visit her sister and accidentally met the man of her dreams. They married and the Canadian husband decided to submit a spousal sponsorship application. Immigration required the biological father to sign an IMM 5604 form giving his consent to let his daughter toi immigrate to Canada.
In 2017 he not only refused to sign the IMM 5604 form but filed for sole custody in the Netherlands. He also told CBSA his daughter had been abducted. Sponsor hires a Dutch Lawyer to defend his wife's custody defence and after an expensive trial the Judge ruled that custody must determined in the country where the child resides aka Canada. IRCC then imply the Mother could be inadmissable for being in violation of A 36 (1) (c) and give us 60 days to respond and prove the Mother has filed for sole custody in Canada. SIXTY DAYS to respond! 60 days to respond during the start of COVID-19.
We asked for compassion proving the genuiness of the relationship. We asked for additional time since Family Courts were closed due to the pandemic. We proved that the biological father was abusive and faced charges in the Netherlands. With the amount of evidence we provided the immigration officer gave us additional time. We just got this email;
