When You Call TOO Often!
Calling the Call Centre TOO often can ruin your chances of maintaining your status within Canada!
Mr. (X) from India called and asked us if we would extend his Temporary Work Permit (TWP) and apply for a Temporary Redisdent Visa (TRV). Like all others he wanted to know the cost and how long the process would take. We told him during this pandemic nobody knows how long the process could take! We didn’t recommend that he travel to India at all because even with a TRV he might not be allowed back into Canada.
Mr. (X) informed me that he needed to extend his TWP based on his wifes PGWP because his TWP would expire in late December 2020. Mr. (X) informed me he was planning to return to India in November 2020 and wanted to know if it would be better to apply for a (TRV) from within Canada or from India so he could return. We informed him that with reduced numbers of staff due to COVID-19 we could not tell him how long it would take for Ottawa to return his passport back with a TRV.
Several months passed and we heard nothing more from Mr. (X)
In the middle of October he retained us to only attempt to extend his (TWP) and informed us he had his filght booked for early November to fly back home to India. We strongly recommended that he should not leave during COVID-19 because the regulations could change very quickly and he might get stuck back in India. Mr. (X) tersely informed me that he had spoken to Immigration and they said he could apply for a TRV from India.
When you call the clerks in the call centre at 1-888-242-2100 day after day to get clarification on extending your temporary work permit (TWP) a certain way they remember you pestering them question after question. Then the Call Centre clerks could put a little NOTE on your file so that when you apply to extend your TWP the following sometimes happens.
Current TWP processing times currently sit a t 158 days. Mr. (X) had left everything until the last possible days to extend his status. Again he claimed he had got verbal permission to still submit his application to extend his TWP from Immigration.
158 days of TWP proceessing times equates to 5.2 months but it appears that IRCC expects to render a decision on his application before February 24th, 2020.
Witnin two days from us submitting an application to extend his TWP we got a reply from the Edmonton CPC. They informed us that they were extending his current TWP until February 24th, 2020 (or until a decision is made on your application) based on regulation R186 (u) which is implied staatus! The next sentence read.
“IF YOU LEAVE CANADA BEFORE A DECISION IS MADE ON YOUR APPLICATION, YOU WILL NO LONGER BE AUTHOURIZED TO CONTINUE WORKING”!
Is this note about Mr. (X) implied status being cancelled if TWP applicants leave Canada is a standard note due to COVID-19 or was it because of Mr. (X) pestering of Call Centre clerks?
