Want Compassion, Don’t Lie!
Recently I had several telephone and video consultations with a an Un-Wed Mother from China who wished to submit a Humanitarian and Compassionate application. It is still against Chinese Law to have a child out of wedlock, so I thought she has a good chance of success. During a video consultation I found out that the biological father of her daughter was black and from the Caribbean. Knowing that in China her Canadian daughter would face serious discrimination I wanted her as my H&C client so much I reduced my retainer fee. BE CAREFUL WHAT YOU WISH FOR!
I have had several Black clients married to White spouses and vice versa but never a Chinese woman involved wuth a Black man. Apparently he was from a Caribbean island and was out of status. Just because I had never heard of such a paiaring doesn’t mean it can’t happen. She claimed that this Black man moved out from her place as soon as she became pregnant. That he had never had any relationship with him since and that he had abandoned her and her daughter. I felt sorry for her.
We agreed to meet in person on Sunday to learn more about this single mother and to be retained for the reduced rate of (X) $$. This is when her story and immigration history started to worry me.
This Un-Wed mother came to Canada and attended a University in Alberta. That meant at least her parents had money to support her foreign student studies. She had graduated and obtained a PGWP Post Graduate Work Permit. She informed me that even with a PGWP of several years she never obtained one year of employment. RED FLAG #1
The Un-Wed mother told me that she returned to China with her PGWP and upon her return made an asylum claim. She had hired an Immigration Lawyer to represent her and that is when everything went wrong. The Lawyer informed the RPD Refugee Protection Division that this Un-Wed mother wanted her to submit a BOGUS asylum claim. That she had filed a complaint against the Lawyer but nothing happened about that. Potential clients who files conplaints against their representatives. RED FLAG #2
During my decades as an Immigration Counsel I have met plenty of failed claimants who claimed they are part of the LGBTQ community and they are not. I still try to solve their situation so why did this Lawyer tell the IRCC that this lady was submitting a BOGUS asylum claim? Why wouold any Lawyer send such information to the RPD instead of just quitting representing such a client. RED FLAG #3
After two hours of In-Person consultation she wanted a further reduction in fees to pay the outstanding amount a month later which I agreed to accept. RED FLAG #4
At 10 a.m. Monday morning I received an email from the UN-Wed mother informing me she wanted to cancel the retainer agreement. She laimed that she could not afford our services even though the payment schedule was clearly negotiated by her on the previous day. Hours of consultation explaining how such a great humanitarian and compssionate application she had and now just a few hours later she wants to cancel. I tried to convince her to continue and file an Humanitarian and Compassionate application.
At 10:30 a man with a Caribbean acent called claiming he was her HUSBAND demanding I refund our fees. He claimed he lives with her and his daughter and that THEY can’t afford our services. He claimed he loves his daughter and takes care of her everyday. RED FLAG #5
Refunded our fees and from now on I will ——- BE CAREFUL WHAT I WISH FOR!
