CBSA issued an arrest warrant, RELAX!
Why are you scared? You are not Osama bin Laden brother or sister, are you? Do you really think CBSA Officers consider you a high priority to arrest? CBSA has tens of thousands of outstanding arrest warrants so you’re nothing more than another file that they will have to deal with when they get time
What are your options if you failed to leave and CBSA issued a warrant for your arrest?
There are many reasons why people are afraid to attend CBSA interviews or leave when told they MUST leave.
The main reason they do not want to be told they MUST apply for a new passport or they MUST leave by __________!
They have fallen in Love and can not stand being separated from their partner.
They paid the government processing fees for an application from within Canada and they want an answer.
Times will be tough if you decide to hide (go underground) because your temporary work permit TWP will expire. You will have to survive on cash jobs only. Others who are underground will tell you to turn off your GPS function on your cell phone. If CBSA has your residential address they will eventually come a knocking, normally at 5 a.m. yelling Peace Office and you will hear Police Officer.
If since you have not complied with instructions has one year expired since you lost your asylum claim. Has one year expired since you were ordered to leave? Your probably eligible to apply for a Pre Removal Risk Assessment (PRRA). You can surrender yourself and the CBSA Officer may release you with special terms and conditions so they can tract your whereabouts. Always be sure to have a potential bondsperson handy who has cash & real property they are willing to put up for your release. A PRRA application while released will normally delay your removal for another six months. Don’t expect to win a PRRA unless you have new evidence that directly relates to your situation.
Having an InLand Spousal application in progress or an Humanitarian and Compassionate applicaion in progress will NOT prevent your removal.
When you originally submitted your InLand Spousal application the two of you were common-law and now you’re legally married - UPDATE your file. If CBSA can not find you, IRCC will call you in for a spousal interview (ATTEND)! At the interview a CBSA Officer will be waiting to arrest you. You will be given a spousal interview. If both of you can convince the immigration officer that you’re in a genuine marriage you will be Approved Stage 1.
After going underground you receive a letter informing you that your Humanitaarian and Compassionate application is APPROVED you can relax a little. You will need to ensure everytime either CBSA or IRCC asks you to submit a document or come in for landing that you comply.
First change your address online to your REAL address.
Arrange an appointment to have CBSA execute (cancel) your outstanding warrant.
Follow all instructions by completeing new documents requested within the time limits.
Always ensure that you take the advice of an experienced Immigration Counsel. Make sure he/she will go with you to any CBSA interviews.
